NOTICE OF REQUEST FOR INFORMATION SURVEY FOR ORGANIC WASTE PROCESSING CAPACITY (BRC0000249) INTRODUCTION PLEASE TAKE NOTICE that Public Works is inviting responses from private and public organic waste processing facility developers to determine the extent of interest and request feedback regarding organic waste processing capacity located within Los Angeles County or other jurisdictions near Los Angeles County. This is a Request for Information (RFI) only and not a solicitation or offer to enter into a feedstock agreement with any respondent. This RFI is issued solely for information gathering and planning purposes. Submission of a response does not bind the County or respondent to any agreement for service or any other work. This does not constitute a Request for Proposals (RFP), Request for Statement of Qualifications (RFSQ), Invitation for Bids (IFB), or a promise to issue a solicitation now or in the future. The information obtained as a result of this RFI, may be used by the County to prepare and release a future solicitation, (e.g., RFP, RFSQ, IFB, or another procurement method) to solicit proposals or procure a sole source agreement. The County may elect to take no further action. Public Works seeks information only and will not provide any reimbursement and will not provide any reimbursement to respondents to this RFI for their costs incurred in providing a response. BACKGROUND Los Angeles County Public Works oversees solid waste collection services for unincorporated County residents and businesses. The recently approved Senate Bill 1383 (SB 1383, 2016) regulations will take effect on January 1, 2022, and will require local jurisdictions such as the County to secure capacity at local facilities to process their residential, multi-family, and commercial organic waste, including food waste, green waste, and food-soiled paper. Estimates indicate that the County currently disposes over half a million tons per year of organic waste, including over 160,000 tons per year of food waste and 130,000 tons per year of paper products. Per the SB 1383 regulations, the County must implement programs to divert the disposed organic waste from disposal. The SB 1383 regulations allow jurisdictions to send mixed waste to high diversion organic waste processing facilities that meet or exceed an annual average mixed waste organic content recovery rate of 75 percent and/or to source separate organic waste for processing. Public Works is not aware of any high diversion organic waste processing facilities with available capacity currently operating within the County. PURPOSE OF THIS REQUEST FOR INFORMATION Through this RFI, Public Works invites responses from all interested private or public developers who own existing organic waste processing facilities or are developing and/or constructing organic waste processing facilities located within the County or neighboring jurisdictions that: 1. Would satisfy the requirements of a high diversion organic waste processing facility as defined by SB 1383 and/or 2. Would be capable of processing commingled food and green waste and/or 3. Would be capable of processing food-soiled paper commingled with food waste and/or 4. Would be capable of processing source-separated food waste Public Works is also encouraging responses from developers of planned facilities that: 1. Currently own or lease land for a planned facility or have signed agreements with waste haulers and/or local jurisdictions to provide at least 50 tons per day of solid waste and/or organic waste, and 2. The facility is expected to begin operating within 3 years Public Works intends to use the information received from this RFI to develop a list of authorized facilities that can be used for SB 1383 compliance. The list will be provided to the County's designated waste haulers. Public Works may require its designated waste haulers that are not in compliance with SB 1383 to enter into feedstock agreements with specified facilities. RESPONSES This RFI invites private or public developers to submit their contact information to be notified if Public Works releases a solicitation to enter into a feedstock agreement with the County and/or its designated waste hauler(s). This RFI also invites respondents to submit their response and any concerns or suggestions regarding why its company or agency would or would not be interested in submitting a proposal in response to a solicitation. Responses shall be submitted in a standard business letter format including the company or agency's letterhead and contain the following information. In order to facilitate the analysis of responses to this RFI, respondents shall prepare their submissions in accordance with these instructions. Submissions shall be prepared as simply as possible and shall clearly be written in the English language. Inadequate, incomplete, or otherwise nonresponsive responses, as determined in the County's sole judgment, will be disregarded. There are two parts/categories to this RFI, and respondents must include the following items in their response: 1. Contact Information 1. Name of company/agency, address, phone number, and fax number 2. Name of contact person, address, phone number, and e-mail address 3. Type of organics processing service provided at the facility 2. Response to the following questions 1. Would your facility be interested in entering into a feedstock agreement with the County's designated waste haulers for residential, multi-family, or commercial organic waste from specified exclusive Residential Franchise Areas, Commercial Franchise Zones, or Garbage Disposal Districts? 2. What would be the minimum term that your facility would consider for a feedstock agreement? 3. What is the length of term your facility would prefer for a feedstock agreement? 4. If Public Works proposed a 5-year term with the possibility of two 5-year extensions, would your facility be willing to enter into an agreement? 5. If Public Works proposed a 10-year term with the possibility of two 5-year extensions, would your facility be willing to enter into an agreement? 6. Waste collection for 1.1 million residents in the unincorporated County is provided through 20 exclusive Residential Franchise contracts and seven exclusive Garbage Disposal District agreements, and additional Garbage Disposal Districts will be established for current open-market areas in the Antelope Valley. Waste collection for over 20,000 businesses in the unincorporated County is currently provided through a non-exclusive franchise system, which Public Works is proposing to transition to an exclusive franchise system with an estimated eight Commercial Franchise Zones of varying sizes. 6a. Please indicate the minimum tonnage that your facility would require to enter into a feedstock agreement. 6b. Please indicate the maximum permitted tonnage of your facility. 6c. Please indicate the maximum capacity in tons that is available (not committed to any jurisdiction or waste hauler) at your facility. 6d. Please indicate the preferred sector(s) (e.g., residential, commercial, multi-family) and bin type(s) (e.g., black bin containing food waste and/or green waste, brown bin with food waste only, green bin with commingled food waste and green waste, brown or green bin also containing food soiled paper, etc.), from which would facility would want to receive waste. 7. What is the rate for the type(s) of organic waste and/or solid waste accepted at your facility? 8. Would your facility consider a tiered rate structure for additional tonnage? 9. Would your facility accept waste from multiple waste haulers and/or jurisdictions? 3. Optional Interview/Clarification The County may, at its option, invite one or more respondents to make a written or verbal clarification, make a presentation, and/or participate in an interview. The deadline to submit responses to this RFI is Tuesday, April 6, 2021, by 5:30 p.m. THE RESPONDENT MUST SUBMIT THEIR RESPONSE ELECTRONICALLY USING ONE OF THE TWO FOLLOWING METHODS: Electronic Submission of Response 1.
